Safety, Indemnity & Assumption of Risk Agreement
Applicable to all retreats, expeditions, and wilderness-based executive development programs.
1. Introduction
Thorndale retreats and expeditions take place in remote wilderness areas and may involve walking, trekking, wildlife exposure, off-road travel, cultural immersion, filming, and outdoor activities. By participating, you acknowledge and accept the inherent risks of such environments.
2. Acknowledgement of the Nature of Activities
By taking part in a Thorndale retreat, you understand that activities may include:
Light-to-moderate walking or trekking
Travel in wildlife areas by 4x4 vehicle or on foot
Exposure to wild animals, uneven terrain, weather, and environmental conditions
Filming and photography by the Thorndale team
Unfenced camping or unfenced rustic accommodation (depending on retreat) in wilderness and conservation areas
Travel in remote or limited-infrastructure regions
3. Assumption of Risk
You acknowledge that participation carries inherent risks including injury, illness, dehydration, heat exposure, natural hazards, unpredictable wildlife behaviour, delayed emergency response, and loss or damage of personal items.
By continuing, you voluntarily assume all such risks.
4. Release & Indemnity
To the fullest extent permitted by law:
You release and hold harmless Thorndale Group (Pty) Ltd (2025/453883/07), its directors, staff, guides, facilitators, partners, and contractors from any liability for injury, illness, death, loss, or damage arising from participation.
Thorndale is not responsible for delays, changes, or cancellations caused by weather, wildlife, logistics, travel restrictions, or other factors beyond its control.
Thorndale is not liable for loss or damage to personal property.
Thorndale reserves the right to remove any participant who behaves in a way that risks personal or group safety, disrupts the experience, or violates cultural or environmental guidelines. No refund will be provided in such circumstances.
5. Medical Disclosure & Responsibility
By participating, you confirm:
You are physically and mentally fit to join the retreat.
All medical information you provide is accurate and complete.
You will bring sufficient prescription medication for the duration of the experience.
You consent to emergency medical treatment if required.
You understand that remote environments may delay medical care or evacuation.
6. Insurance
International retreats: Comprehensive travel insurance (including medical evacuation) is mandatory.
South African retreats: Personal medical aid or private insurance is strongly recommended.
Thorndale may request proof of insurance prior to participation.
7. Behaviour & Safety Compliance
You agree to:
Follow all safety briefings and instructions
Respect wildlife, local communities, guides, and facilitators
Refrain from alcohol or substance use that may impair safety
Uphold cultural and environmental guidelines
8. Photography & Filming
You consent to being filmed or photographed as part of your personal leadership story asset, which will be delivered after the retreat.
Thorndale will not use your footage or stills for marketing without your written consent.
9. Legal Jurisdiction
This agreement is governed by South African law.
